1. Introduction
1.1 These Terms and Conditions govern the sale of products through the site https://aqualand-industries.com. We are Aqualand Industries (Products) Ltd, registered in the UK.
1.2 All orders placed by you and purchases of goods from us via our website are subject to these Terms and Conditions and are subject to acceptance by us. A legally binding contract is formed upon dispatch of the goods.
1.3 The processing of your payment and acknowledgment of your order (including sending you an email confirming your order is being processed) does not constitute legal acceptance of your order.
1.4 The goods supplied by us are recreational products intended for leisure use. They should be used in accordance with any instructions provided. We are not responsible for misuse of the products or use outside their intended purpose.
2. Ordering
2.1 On our website, you may place an order to purchase a product advertised for sale by following the onscreen prompts. You will have the opportunity to review and correct any errors before submitting your order at checkout.
2.2 All orders are subject to acceptance by us. We reserve the right to refuse an order for reasons including, but not limited to:
2.3 Where we accept your order, we have a legal duty to supply goods that are in conformity with these Terms and Conditions.
2.4 We take reasonable care to ensure that product descriptions and images are accurate. However, colours and appearance may vary slightly due to screen settings or lighting, and images may be for illustrative purposes only.
2.5 Product packaging may vary from that shown on our website from time to time.
2.6 Any general guidance we provide regarding product use is for information only and does not replace your own judgement. Products should be used in accordance with any instructions provided.
3. Price & Payment
3.1 The price payable for the goods is the price shown on our website at the time you place your order, plus any delivery charges shown at checkout. All prices are shown in pounds sterling (£) and include VAT (where applicable) unless stated otherwise.
3.2 We may change prices and delivery charges from time to time, but any changes will not affect orders that have already been accepted by us.
3.3 If we offer a promotion code or discount, you must enter it at checkout for it to apply. Promotion codes cannot usually be applied after an order has been placed.
3.4 If an obvious pricing or product description error is identified, we are not obliged to supply goods at the incorrect price or in accordance with the incorrect description. Where this happens, we will contact you and you may choose to proceed at the correct price/description or cancel for a full refund.
3.5 Payment must be received in full (including delivery charges) before an order can be dispatched.
3.6 Payment can be made using the payment methods made available at checkout (for example debit/credit card, Shop Pay, PayPal and/or other providers shown on the checkout page). Payment processing is handled securely by our payment providers.
3.7 By placing an order and choosing a payment method, you confirm that you are authorised to use that payment method.
3.8 All card payments are subject to authorisation by your card issuer and all PayPal payments are subject to authorisation by PayPal. If payment is not authorised, we will not accept your order.
3.9 Please do not send payment card details by email. We will never ask you to provide your full card details by email.
4. Delivery, Risk & Title
4.1 We aim to process and dispatch orders within 1–3 working days. Once dispatched, delivery is handled by our courier (for example Royal Mail) and typically takes 2–5 working days, depending on the service selected and your location.
4.2 All delivery times are estimates only and are not guaranteed.
4.3 If we cannot deliver to your address (for example due to courier restrictions), we will contact you and may cancel the order and refund you.
4.4 Risk of loss or damage passes to you when the goods are delivered to the address provided in your order.
4.5 Title (ownership) to the goods passes to you once we have received payment in full.
4.6 You should check your order on delivery. If your item arrives damaged, faulty, or incorrect, please contact us as soon as reasonably possible using the contact details in clause 14 so we can help.
4.7 We are not responsible for delivery delays outside our control (for example courier delays), but we will do what we reasonably can to assist you in resolving delivery issues.
4.8 We currently ship to addresses within the United Kingdom only. We do not offer international delivery at this time.
5. Collection
We do not currently offer a Click & Collect or in-person collection service.
6. Availability
6.1 All goods are subject to availability.
6.2 If an item becomes unavailable after you place an order, we will contact you and either offer an alternative (where appropriate) or refund you for the unavailable item(s).
7. Intellectual Property
7.1 We own (or license) all intellectual property rights in our website, branding, logos, product names and content. All rights are reserved.
7.2 You may print or download extracts of our website for your personal, non-commercial use only. You must not use any part of our content for commercial purposes without our prior written consent.
7.3 If you post reviews or comments about our goods or service, you must ensure they represent your honestly held opinions and you must not post unlawful, abusive or misleading content.
8. Cancellations, Returns & Refunds
8.1 We want you to be happy with your purchase. Our returns process is set out below and may also be summarised in our Returns Policy.
Cancellation rights (UK consumers)
8.2 If you are a UK consumer buying online, you generally have the right to cancel your order within 14 days of receiving your goods (the “cooling-off period”), for any reason. To exercise your right to cancel, you must notify us clearly by email to bucketgolf@aqualand-industries.com within that 14-day period.
8.3 If you cancel, you must return the goods to us within 14 days of notifying us that you wish to cancel. You must take reasonable care of the goods while they are in your possession. You may inspect the goods as you would in a shop, but you may be responsible for any diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
8.4 If you cancel under clause 8.2, we will refund the price paid for the goods and the standard outbound delivery charge (if applicable) within 14 days of receiving the returned goods (or evidence of return). We may make the refund using the same payment method you used, unless agreed otherwise.
8.5 Unless the goods are faulty or incorrect, you are responsible for return postage costs. We do not currently offer free returns for change-of-mind purchases.
Faulty, damaged or incorrect goods
8.6 If the goods are faulty, damaged, or not as described, you have legal rights. Please contact us with your order number and details of the issue. We may ask for photos/videos to help us assess the problem quickly.
8.7 Where goods are confirmed to be faulty/damaged/incorrect, we will offer an appropriate remedy in line with your legal rights (for example repair, replacement, or refund) and we will cover reasonable return costs where applicable.
Exclusions
8.8 The right to cancel may not apply to certain goods in specific circumstances (for example clearly personalised goods), where permitted by law. If we sell any such goods, we will make this clear on the product page.
8.9 This clause 8 does not affect your statutory rights as a consumer.
9. Liability
9.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
9.2 Subject to clause 9.1, we are not liable for losses that are not reasonably foreseeable.
9.3 Subject to clause 9.1, our total liability to you in connection with any order will not exceed the total amount paid by you for that order.
9.4 Our goods are intended for recreational use. You must use them responsibly and in accordance with any instructions provided. We are not responsible for misuse of the goods.
10.Termination/Refusal of service
10.1 We may cancel an order before dispatch if we reasonably believe that an order is fraudulent, placed in error, or otherwise unlawful. If we cancel an order, we will refund any sums paid.
11. Events Beyond Our Control
11.1 We are not responsible for delays or failures caused by events outside our reasonable control (for example severe weather, courier disruptions, or other major events). Where possible, we will keep you updated and work to resolve any issues.
12. General
12.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
12.2 We may update these Terms from time to time. The version in force will be the one available on our website at the time you place your order.
12.3 A person who is not a party to this contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this contract.
12.4 You may not transfer your rights under these Terms. We may transfer our rights and obligations under these Terms where this does not reduce your rights.

13.1 We process personal data in accordance with our Privacy Policy, which is available on our website.
